These Terms and Conditions are subject to the project, the clients' requirements, and our parties' agreement.
1. AGREEMENT
These terms and conditions govern the agreement between the client (referred to as "Client") and David Broadway Pty Ltd (referred to as "David Broadway") concerning photographic and videographic services.
2. DATA PRIVACY
All information submitted on this website is securely stored and will not be sold. Contact details may be used for marketing, newsletters, and communication by David Broadway Pty Ltd.
3. COPYRIGHT
All images remain the property of David Broadway unless otherwise agreed in writing.
4. SOCIAL MEDIA USAGE
Credit on social media is appreciated when images are used. Please tag or mention David Broadway on Instagram @davidbroadway, Twitter @david_broadway, Facebook @DavidBroadwayPhotographer, and LinkedIn @davidbroadway LinkedIn Company @david-broadway-pty-ltd.
5. RATES & PAYMENT
The full day rate is based on 8 hours, and the half day rate is based on 4 hours. A 50% deposit is required to secure bookings, due before the shoot. Full payment is required before delivery, with a 3% surcharge on credit card payments. Prices are in AUD, exclude GST, and are subject to GST.
6. CANCELLATION & POSTPONEMENT
If the Client cancels or postpones, expenses incurred by David Broadway are payable. Deposit/booking fees are non-refundable. Cancellations within 24 hours incur fees.
7. COSTS OF RECOVERY
Debtors are responsible for all costs in recovering owed monies under this agreement.
8. TRAVEL & EXPENSES
Travel rates apply outside the Perth service area. Clients pay all associated costs, including travel, parking, flights, transfers, car hire, taxi, and accommodation.
9. POST PRODUCTION
Depending on the project the retouching is quoted per image, hourly rate or fixed fee.
10. DELIVERY & TURNAROUND TIME
Photos are delivered in JPEG format by digital download. Turnaround time is generally ranges from 48hrs to 10 business days depending on client brief and agreement. Rush fees apply for on-the-day or next-day turnaround.
11. RETRIEVAL & STORAGE
Clients may request copies within 30 days at no cost. Retrieval fees may apply after this period. Original images are backed up by David Broadway, with no liability for loss beyond control.
12. AUTHORSHIP CREDIT
A Photographer's credit accompanies photographs where practical. A publishing fee is payable if a credit cannot be displayed.
13. VIDEO, FILM CREATION
RAW video is stored for maximum 6 months. Final video exports are stored for 24 months. Video production include one round of changes before fees apply. Music license not included. Turnaround time is up to 4 to 6 weeks. Rush fees apply for on-the-day or next-day turnaround.
14. FINAL NOTES
These terms are subject to modification with the mutual agreement of both parties. Any changes should be agreed upon in writing.
